General Terms and Conditions of Sale

Preamble

These general terms and conditions of sale (hereinafter "GTC") govern the contractual relationship between Recyclage Express Sàrl (hereinafter "the Seller" or "Recyclage Express"), whose registered office is located at Avenue de Riond-Bosson 12, 1110 Morges, Switzerland, operating the Recyclage Market point of sale and website, and any natural or legal person (hereinafter "the Buyer") making a purchase on the website. https://recyclage-market.ch/ (hereinafter "the Site") or in store under the Recyclage Market banner.

Recyclage Market is an activity of Recyclage Express Sàrl, specializing in the sale of second-hand items from clearance services carried out by the same company.

The Buyer declares that he has the full legal capacity to enter into this agreement under these Terms and Conditions.

Article 1 – Purpose

These General Terms and Conditions of Sale define the rights and obligations of the parties within the framework of online and in-store sales of goods offered by the Seller to the Buyer. They apply, without restriction or reservation, to all sales concluded by Recyclage Express Sàrl under the Recyclage Market brand.

Article 2 – Acceptance of the General Terms and Conditions

The Buyer declares having read and accepted these Terms and Conditions before placing their order. Order confirmation constitutes unreserved acceptance of these Terms and Conditions.

Article 3 – Products

3.1 Product Description

The products offered for sale are those listed on the Site and in store, on the day of consultation by the Buyer, and within the limits of available stocks.

The products are described and presented as accurately as possible. However, if any errors or omissions occur in this presentation, the Seller cannot be held liable. Product photographs are not contractual. The Buyer is advised to refer to the description of each product for its precise characteristics.

3.2 Product Condition

The products offered by Recyclage Market are second-hand items, either "new" (never used but from clearance or end-of-line stock) or "slightly used". The condition of each product is specified in its description.

3.3 Product Availability

The Seller undertakes to fulfill orders received within the limits of available stock. If a product becomes unavailable after an order has been placed, the Buyer will be informed by email or telephone as soon as possible. They will then have the option of requesting cancellation and a refund of the order or maintaining it with an extended delivery timeframe.

Article 4 – Price

Product prices are listed in Swiss Francs (CHF), inclusive of all taxes (VAT included). They reflect the VAT rate applicable on the date of the order. Any change in the applicable VAT rate will be automatically reflected in the product prices.

The Seller reserves the right to change its prices at any time, it being understood however that the price appearing on the Site or in store on the day of the order will be the only one applicable to the Buyer.

The prices shown do not include any delivery charges, which are billed separately and indicated before order confirmation, if applicable.

Article 5 – Order

5.1 Online Ordering Process

A buyer wishing to purchase a product online must:

  • Select the product and add it to your cart.
  • Confirm the contents of your shopping cart.
  • Log in or create a customer account by providing the required information.
  • Choose your payment method.
  • Confirm your payment.
  • Confirm your order and payment.

Order confirmation implies acceptance of these Terms and Conditions, acknowledgment of having full knowledge thereof and waiver of any right to invoke one's own terms of purchase or other conditions.

All data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will constitute a signature and acceptance of the operations performed.

The Seller will send an email confirming the order.

5.2 In-Store Ordering Process

The Buyer selects the products in store and proceeds to payment directly at the checkout.

5.3 Order Cancellation

Recyclage Express Sàrl reserves the right to cancel or refuse any order from a Buyer with whom there is a dispute relating to payment for a previous order, or for any other legitimate reason, including in the event of suspected fraud.

If an order is not collected within 14 days of the order date (excluding delivery requests), Recyclage Express Sàrl reserves the right to cancel the order and relist the product. A refund will only be issued upon the Buyer's express request, after verification that there are no outstanding disputes.

Article 6 – Payment

Payment is due upon ordering.

6.1 Online Payment Methods

Online payments can be made by:

  • Bank card: Accepted bank cards are those from the Carte Bleue, Visa, and MasterCard networks.
  • TWINT: Mobile payment via the TWINT app.
  • Bank transfer: The Seller's bank details will be provided to the Buyer upon confirmation of the order.

6.2 In-Store Payment Methods

In-store payments can be made by:

  • Species.
  • Bank card: Accepted bank cards are those from the Carte Bleue, Visa, and MasterCard networks.
  • TWINT: Mobile payment via the TWINT app.

6.3 Payment Security

Online payments by credit card are secured by a data encryption system. The Seller does not have access to the Buyer's bank details.

6.4 Default of Payment

In the event of total or partial non-payment of the price by the due date, the Seller reserves the right to suspend or cancel the order and/or delivery.

Article 7 – Retention of Title

The products remain the property of the Seller until full payment of the price by the Buyer.

Article 8 – Delivery / Provision of Products

8.1 In-Store Pickup (Click & Collect)

Products ordered online or reserved by phone can be collected free of charge in store at the following address:

Hours of operation : Tuesday to Friday: 2pm – 6pm Saturday: 9am – 6pm

A confirmation email or SMS will be sent to the Buyer when their order is ready for collection. The Buyer must bring valid identification and their order number to collect their products. Orders must be collected within 14 days of the order date, unless a longer period has been agreed upon or delivery has been arranged.

8.2 Delivery

Recyclage Express Sàrl offers an on-demand delivery service, provided by its own teams. Delivery costs are calculated based on the volume and weight of the products and the delivery address. A quote will be provided to the Buyer upon request. Deliveries are made only within Switzerland.

8.3 Deadlines

Products are delivered to the address provided by the buyer. Delivery times vary and will be communicated upon order confirmation. Delivery for bulky items must be selected and paid for separately from the order.

8.4 No Automatic Delivery

No deliveries are made automatically. Items must be collected in store, unless an express delivery request has been made by the Buyer and validated by Recyclage Express Sàrl.

Article 9 – Right of Withdrawal, Returns and Exchanges

9.1 Right of Withdrawal (Only for online purchases)

In accordance with Swiss law, the Buyer has a 14-day right of withdrawal from the date of receipt of products ordered online, with the exception of purchases made directly in-store. To exercise this right, the Buyer must notify the Seller of their decision to withdraw by email to the following address: info@recyclage-market.ch, specifying their name, order number and the products concerned.

9.2 Returns

Recyclage Express Sàrl accepts returns for both defective and non-defective products. Returns must be made in-store at the following address:

9.3 Exchanges

Recyclage Express Sàrl accepts product exchanges. Exchanges must be made in-store at the address mentioned above.

9.4 Return and Exchange Conditions

  • Product condition: Products, whether new or lightly used, must be returned in their original condition, complete (accessories, instructions, etc.) and undamaged. Damaged, soiled, or incomplete products will not be accepted for return, exchange, or refund.
  • Deadline : Returns and exchanges must be made within a maximum of 12 days of receiving the order for optimal inspection of electronic products, and a maximum of 3 weeks for non-electronic items from the date of purchase.
  • Modality: Returns and exchanges are only accepted in store.
  • Proof of defect: For electronic items, the Buyer must provide proof of the defect (photo or video) before returning the product to the store.

9.5 Restocking Fees

No restocking fees will be applied.

9.6 Reimbursement

The Seller undertakes to reimburse the Buyer within a maximum of 30 days following receipt of the returned product in store and verification of its condition. The reimbursement will be made via the same payment method used for the order, unless the Buyer expressly agrees to another method. For items purchased by card or via TWINT, the reimbursement will be made exclusively via the same payment method.

Article 10 – Warranty

10.1 Legal Guarantee

The products sold by Recyclage Express Sàrl benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, as provided for by the Swiss Code of Obligations.

10.2 Specific Warranty for Electronic Items

All electronic items sold by Recyclage Express Sàrl are covered by a 3-month warranty from the date of purchase. This warranty covers manufacturing defects and malfunctions not attributable to misuse of the product by the Buyer. In the event of a defect covered by the warranty, the Buyer must contact the Seller by email at the address info@recyclage-market.ch, by providing a detailed description of the problem and, if possible, a photo or video. After validation, the defective item must be returned to the store. The Seller will then, at their discretion, repair, replace, or refund the defective product.

Article 11 – Liability

In the online sales process, the Seller is only bound by an obligation of means. The Seller cannot be held liable for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruptions, or other unintentional problems.

The Seller shall not be held liable in the event of misuse of the products, failure to comply with the instructions for use, or normal wear and tear of the products.

Article 12 – Force Majeure

Neither party shall be deemed to have failed in its contractual obligations to the extent that their performance is delayed, hindered, or prevented by a fortuitous event or force majeure. A fortuitous event or force majeure shall be defined as any irresistible event or circumstance beyond the control of the parties, unforeseeable, unavoidable, independent of the will of the parties, and which cannot be prevented by them despite all reasonable efforts.

Article 13 – Personal Data

The Seller undertakes to respect the confidentiality of personal data communicated by the Buyer and to process it in compliance with the Federal Act on Data Protection (FADP) and the General Data Protection Regulation (GDPR) of the European Union, to the extent that it is applicable.

The information collected is subject to computer processing for the purposes of order management, product delivery, invoicing and customer relationship management.

The Buyer has the right to access, rectify, object to, and delete their personal data. To exercise this right, they can contact the Seller by email at the address info@recyclage-market.ch.

Article 14 – Intellectual Property

All elements of the Site (texts, images, logos, trademarks, etc.) are and remain the exclusive intellectual property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the Site, whether software, visual, or audio, without the prior written consent of the Seller.

Article 15 – Applicable Law and Disputes

These terms and conditions are governed by Swiss law.

In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the Swiss courts will have sole jurisdiction.
